Terms of Service

These Terms of Service (“Terms”) govern your use of Wildlost’s websites, web app, and iOS app (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
1. The Service
Wildlost is an outdoor mapping application for viewing terrain and map layers, planning routes, recording tracks, organizing map data, downloading offline regions, and optionally syncing and collaborating on atlases you control.
The Service is provided for personal and outdoor planning use. It is not a substitute for proper trip planning, navigation skill, judgment, or emergency services. Maps, trails, weather, elevation, and related data can be incomplete, outdated, or wrong. Always verify critical information with authoritative sources and on-the-ground conditions.
2. Eligibility
You must be at least 13 years old (or the higher age of digital consent in your region) to create an account. By using the Service you represent that you meet this requirement and can form a binding contract.
3. Accounts
- You are responsible for your account credentials and for activity under your account.
- Provide a valid email address and keep it current so we can send verification and security-related messages.
- You may use the Service signed out in Local mode; cloud sync, Pro entitlements, and multi-device sync require an account.
- You may schedule deletion of your account from the account page. Cloud data is purged after a grace period (currently 30 days). Device-only data may remain on your devices until you remove it.
- We may suspend or terminate accounts that violate these Terms or that create risk to the Service or other users.
4. Your content
“Your Content” means routes, tracks, waypoints, notes, photos, map sheets, atlases, layer configurations, and other material you create, import, or upload.
- You retain ownership of Your Content.
- You grant Wildlost a limited license to host, store, backup, transmit, display, and process Your Content solely to operate and improve the Service (including sync and features you enable).
- You are responsible for Your Content and for having the rights to upload and share it.
- Do not upload unlawful, infringing, malware-laden, or abusive material.
Sharing
Wildlost does not provide a public social feed or public discovery of other users’ tracks. If you share an atlas by invite or share link, you control that sharing. Anyone with access may view or edit according to the permissions you set. You are responsible for who you invite and for links you distribute.
5. Acceptable use
You agree not to:
- Abuse, overload, or disrupt the Service or its infrastructure
- Attempt unauthorized access to accounts, systems, or non-public APIs
- Scrape, bulk-download, or redistribute our hosted tile sets, indexes, or media in a way that competes with or harms the Service, except as allowed by export features or open-data licenses for third-party data
- Circumvent Pro entitlements, rate limits, or access controls
- Use the Service to harass, stalk, or endanger others, or to violate law
- Misrepresent affiliation with Wildlost
We may investigate and take action, including removal of content and account termination.
6. Subscriptions and payment (Pro)
Wildlost offers a free tier and optional Pro paid features (for example certain imagery/basemap layers, historic topo, forecast layers, and photo upload). Feature lists may change.
- Web Pro subscriptions are billed through Stripe. Prices, billing interval, and taxes are shown at checkout.
- By subscribing you authorize recurring charges until you cancel.
- Cancel anytime via the Stripe customer portal linked from your account page. After cancellation, Pro access typically continues through the end of the current paid period.
- Except where required by law, fees are non-refundable. Chargebacks or payment disputes may result in suspension of paid features.
- We may change Pro pricing or entitlements with notice; changes apply to subsequent billing periods unless otherwise stated.
App Store in-app purchase terms, if offered later, will be disclosed in the app and governed also by Apple’s terms.
7. Third-party data and services
The Service displays or proxies data from third parties (for example USGS, OpenStreetMap contributors, weather agencies, and commercial tile providers). That data is subject to the providers’ terms and attribution requirements. We do not warrant third-party data accuracy or availability.
Payment processing is handled by Stripe under Stripe’s terms.
8. Intellectual property
The Service—including our software, branding, design, and documentation—is owned by WildLost LLC and its licensors. These Terms do not grant you rights to our trademarks or to copy the Service except as needed for normal use.
Open-source components and third-party map data retain their own licenses.
9. Privacy
Our Privacy Policy describes how we handle personal information. By using the Service you acknowledge that policy.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Outdoor travel involves inherent risk. You assume all risk arising from reliance on the Service for navigation, trip planning, or decision-making in the field. Carry backup navigation and emergency plans.
We do not guarantee uninterrupted or error-free operation, perfect sync, or completeness of offline packages.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDLOST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations; in those places our liability is limited to the fullest extent allowed.
12. Indemnity
You will defend and indemnify Wildlost against claims, damages, and expenses (including reasonable attorneys’ fees) arising from Your Content, your sharing of content, or your misuse of the Service, to the extent permitted by law.
13. Changes to the Service or Terms
We may modify or discontinue features. We may update these Terms by posting a revised version with a new effective date. Continued use after changes become effective constitutes acceptance, except where applicable law requires otherwise. If you do not agree, stop using the Service and delete your account.
14. Termination
You may stop using the Service at any time and may delete your account as described in the product. We may suspend or terminate access for breach, risk, prolonged inactivity, or if we shut down the Service. Provisions that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.
15. Governing law
These Terms are governed by the laws of the State of Colorado, excluding conflict-of-law rules. Exclusive jurisdiction and venue lie in the state or federal courts located in Colorado, except where prohibited by consumer-protection law in your country of residence.
16. Miscellaneous
- These Terms are the entire agreement between you and us regarding the Service.
- If a provision is unenforceable, the rest remains in effect.
- Failure to enforce a provision is not a waiver.
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Notices may be provided via the Service, email, or posting on our website.
